Process to Defend Your Legal Rights

Step 1 – the Notice of Appearance

This is where we come in – at the beginning. We usually file a Notice of Appearance, Plea of Not Guilty, and Demand for Trial all in one pleading. Often, we will demand a Jury trial – to best protect your rights.

Step 2 – the Pretrial Conference

After we file the above document, the court will set a Pre-Trial conference. This is an attempt by the Court to get you to plea the case out without a trial. At the Pre-Trial Conference, the judge may offer no points and no school.

Step 3 – the Trial

The judge calls the cases in order that they are in the computer. If the essential witnesses are not there, we can make a motion to dismiss for lack of prosecution and the judge will most likely grant it. Proof is beyond a reasonable doubt and for charges such as speeding we utilize Chapters 316 and 322 of the Florida Statutes dealing with what constitutes a road, calibrated speed measuring devices, and even the Florida Administrative Code, which lays out the calibration procedures that officers must follow.
