each case. The case results that follow do not guarantee or predict
a similar result in any future case we undertake. However, they will
give you an idea of the type of work we do.

Personal Injuryy: Car Accident
On May 11, 2005, Massey & Duffy won a jury verdict of $554,048.07 in a case involving a rear-end motor vehicle accident. This verdict has been reported in the Florida Jury Verdict Review as one of the largest of its kind. Ash v. Geoline Surveying, 03-2671-CA-K (Marion County, Fla. 2005). The verdict was fully paid by the insurance company.
Given that one of our attorneys was a Staff Attorney for a federal court of appeals, it is common that clients contact us to handle appellate matters. We also appeal whenever faced with an unjust ruling. Recent successful appeals, resulting in reversals, include the following: Haigh v. Planning Bd. of Town of Medfield, 940 So.2d 1230 (Fla. 5th DCA 2006) and Robyn v. Forest River, Inc., 913 So.2d 743 (Fla. 5th DCA 2005). We also handle appeals to the United States Court of Appeals for the Eleventh Circuit.
Class Actions/Collective Actions:
FLSA Collective Action
In May, 2004, Massey & Duffy successfully certified a labor law collective action for loan officers across the Southeast seeking overtime compensation against a large mortgage company based on violations of the Fair Labor Standards Act's overtime provisions. Epps, et al. v. Oak Street Mortgage, LLC, 5:04-cv-46 (M.D.Fla. 2004). In May, 2006, Massey & Duffy defeated the mortgage company's motion for decertification for the class of loan officers who claimed they had been misclassified as exempt. Epps, et al. v. Oak Street Mortgage, LLC, Slip Copy 2006 WL 1460273 (M.D. Fla. May 30, 2006).
Employment Law:
Pregnancy Discrimination and Retaliation
On July 13, 2007, Massey & Duffy defeated an employer's motion for summary judgment in a case in which the plaintiff alleged she had been discriminated and retaliated against after announcing her pregnancy. McCullen v. RDR, LLC, d/b/a Beef O'Brady's, Inc., Slip Copy 2007 WL 2071362 (M.D. Fla. July 13, 2007). Massey & Duffy persuaded the Court that there was ample of evidence of unlawful pregnancy discrimination and retaliation, including evidence supporting the plaintiff's claim that she was constructively discharged.
On June 20, 2007, Massey & Duffy won a significant victory in Marion County Circuit Court, when the Court denied Marion County School Board's motion for summary judgment and allowed the plaintiff to proceed to trial on his age discrimination claim under Florida's age discrimination statute. Hayden v. Marion County School Board, a/k/a Marion County Public Schools, Case No. 2004-1008-CAG (Marion County, Fla. June 20, 2007).
Commercial Law:
Commercial Tort/Slander
On February 24, 2006, a Federal Court Jury returned a verdict of $400,000.00 in a case involving a former employee suing a large local business. Massey & Duffy proudly represented the employee, and was pleased to vindicate her rights. Cadieux v. Ocala Breeder Sales, Inc., 5:04-cv-355 (M.D. Fla 2006).

Defense Cases:
On May 20, 2005, we successfully defended an ADA discrimination case brought against a local hotel; the case ended in summary judgment. Access 4 All, Inc., et al v. Oak Spring, Inc., 5:04-cv-00075-GRJ (M.D. Fla. 2005). We also recently defended a company sued by an employee under Title VII; the case was resolved shortly after we entered an appearance in the case.
